2. Acceptance of Terms
By accessing or using the services of National Courier Express, LLC (“Company”, “we”, “us” or “our”), the customer (“you” or “Client”) agrees to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use our services
3. Services Provided
We collect the following categories of information to provide and improve our services: The Company provides courier and logistics services specializing in the transportation of pharmaceuticals, medical supplies, equipment, lab specimens, documents, and other healthcare-related items.
Our services may include, but are not limited to:
- STAT and routine deliveries
- Specimen transport
- Prescription delivery
- Medical equipment logistics
- Scheduled routes
- On-demand pick-ups
4. Eligibility
Clients must be:
- Authorized representatives of a legal entity (e.g., hospital, clinic, lab, pharmacy, home health agency, etc.)
- At least 18 years of age
- In compliance with applicable federal, state, and local laws
5. Compliance and Safety
You agree to:
- Comply with all applicable regulations including OSHA, HIPAA, and CDC guidelines.
- Properly label and package all medical items in accordance with applicable laws.
- Notify the Company of any hazardous or biohazardous material.
- Provide all documentation required for legal transport (e.g. chain of custody forms, MSDS, etc.).
6. Delivery Terms
- Pickup and Dropoff Times: We strive to meet requested times but do not guarantee specific delivery windows unless under contract.
- Delays and Incidents: We are not liable for delays caused by force majeure, weather, traffic, accidents, or inaccurate pickup/delivery information.
- Proof of Delivery: Signatures, timestamps, or photographic evidence may be used as proof of delivery.
7. Pricing and Payment
- Rates: Pricing is based on weight, distance, urgency, and service level.
- Billing: Clients are invoiced weekly and must remit payment within 30 days.
- Late Payments: A 1.5% monthly late fee may be assessed for overdue accounts.
- Disputes: Any billing disputes must be submitted in writing within 15 days of the invoice.
8. Liability and Insurance
- Limitation of Liability: The Company’s liability for loss or damage is limited by the contract agreement unless declared value coverage is purchased.
- Exclusions: We are not liable for:
- Improper packaging by the sender
- Delays beyond our control
- Perishable goods unless agreed in writing
- Insurance: Clients may purchase additional insurance coverage upon request.
9. HIPAA and Data Protection
- The Company is committed to protecting the confidentiality and security of Protected Health Information (PHI) in compliance with the Health Insurance Portability and Accountability Act (HIPAA).
10. Client Responsibilities
You agree to:
- Provide accurate delivery instructions and contact information
- Properly package and label items
- Ensure accessibility for pickups and deliveries
- Notify the Company immediately of any discrepancies and changes to an existing request
11. SMS Terms and Conditions
- SMS Consent Communication: Information (phone numbers) obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.
- Types of SMS Communications: If consent has been given to receive text messages from National Courier Express, messages may be received related to the following:
- Sending shipment updates and service notifications.
- Responding to customer inquiries and service requests.
- To send operational notices, reminders, or urgent alerts.
- Billing inquiries.
- To share promotional, educational, or service-related content (only with prior consent).
- Message Frequency: Message frequency may vary depending on the type of communication or frequency of shipment.
- Potential Fees for SMS Messaging: Standard message and data rates may apply, depending on the carrier’s pricing plan. These fees may vary if the message is sent domestically or internationally.
- Opt-In Method: Opt-in to receive SMS messages from National Courier Express can be done in the following ways:
- Verbally, during a conversation
- By submitting an online form
- By filling out a paper form
- Opt-Out Method: Opting out of receiving SMS messages can be done at any time by replying “STOP” to any SMS message received. Alternatively, direct contact can be made to request removal from the messaging list.
- Help: For any issues, reply with the keyword HELP. Alternatively, help can be obtained directly from us atwww.NationalCourierExpress.com
- Additional Options: If SMS messages are not desired, the SMS content box on forms can be left unchecked.
- Standard Messaging Disclosures: Message and data rates may apply. Opt out at any time by texting “STOP”. For assistance, text “HELP” or visit our Privacy Policy and Terms and Conditions pages.
12. Cancellations and Refunds
- Cancellations made less than 1 hour before scheduled pickup may incur a cancellation fee.
- Refunds for delayed or failed deliveries are granted at the Company’s sole discretion.
13. Independent Contractor Status
- Drivers and couriers engaged by the Company may operate as independent contractors. This does not affect our obligations to you, but we are not liable for their personal conduct outside the scope of delivery services.
14. Termination
We reserve the right to suspend or terminate service:
- For breach of these Terms
- Due to non-payment
- If service presents a risk to safety or compliance
15. Dispute Resolution
- Governing Law: These Terms are governed by the laws of the State in which services are rendered
- Arbitration: Any dispute not resolved informally shall be submitted to the binding arbitration in City/State in which services are rendered
16.Modifications
We may update these Terms at any time. Changes will be posted on our website with a revised effective date. Continued use of our services constitutes acceptance of the updated Terms.
